⚠️ Important Notice About Emergency Services
SAFELY does NOT replace or directly connect to official emergency services (911, 112, ambulance, police, fire department). The app only provides the following functions: • Sends notifications to your trusted contacts • Shares your location with your trusted contacts • Communicates your emergency status to your loved ones In a real emergency, always call 911/112 or use your local emergency services. SAFELY is not responsible for emergency services' response time, quality of intervention, or outcomes.
1. Acceptance
By using the SAFELY application, you accept these terms of use. If you do not accept the terms, please do not use the application.
2. Eligibility
To use SAFELY: • You must be at least 13 years old • You must have legal capacity to enter binding contracts • Use must be legal in your country If you are under 18, parental or guardian consent is required.
3. User Responsibilities
When using SAFELY: • You are responsible for your account security • You must provide accurate and current information • You must not use the app for illegal purposes • You must not violate others' rights • You must not attempt to manipulate or damage the system
4. Subscriptions and Purchases
SAFELY offers three membership plans: • Basic (Free): Essential features • Premium Monthly ($9.99/month): Advanced features, unlimited usage • Premium Yearly ($99.99/year): Annual premium membership • VIP Monthly ($99.99/month): Complete monthly package for enterprise and families • VIP Yearly ($990/year): Complete annual package for enterprise and families New User Gift: • Every new user receives 7 days of free Premium membership Subscription Terms: • Subscriptions automatically renew • Prices may change, changes will be notified in advance • Payment will be charged to your iTunes Account at confirmation of purchase • Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period • Your account will be charged for renewal within 24 hours prior to the end of the current period • Subscriptions may be managed by the user and auto-renewal may be turned off by going to the user's Account Settings after purchase • Any unused portion of a free trial period, if offered, will be forfeited when the user purchases a subscription Cancellation and Refunds: • Cancellations are subject to Apple App Store policies • For refund requests, you must contact Apple • Canceling a subscription does not affect access until the end of the current period
4. Prohibited Uses
The following uses are strictly prohibited: • Harassing or threatening others • Using false information or identity • Sending spam or unwanted content • Spreading viruses or malicious code • Reverse engineering the application • Unauthorized access to others' accounts Accounts violating these rules may be suspended or deleted.
5. Disclaimer - Not Professional Help Services
IMPORTANT: SAFELY IS NOT A SUBSTITUTE FOR PROFESSIONAL HELP SERVICES. SAFELY is a safety and communication tool, but: • Call 112 in life-threatening situations • We cannot guarantee SAFELY will always work • Requires internet connection • Location accuracy may vary • Notifications may be delayed or not delivered Use official help services for life-threatening situations.
6. Limitation of Liability
To the extent permitted by law: • SAFELY is provided 'as is' without warranty • We are not responsible for service interruptions • We are not responsible for data loss • We are not responsible for indirect or incidental damages • Our maximum liability, to the extent permitted by law, shall not exceed the total amount paid by the user for the subscription in the preceding 12 months Some jurisdictions do not allow liability limitations, in which case the above may not apply.
7. Intellectual Property
The SAFELY application and all content (logo, design, code) are owned by TrairX Technology O.Ü. Users: • May use the app for personal use • May not copy, modify, or distribute content • May not use for commercial purposes (without permission) All trademarks are property of their respective owners.
8. Changes
We may change these terms at any time. For significant changes: • We will send in-app notifications • We will notify by email (if available) • Changes take effect after publication Continued use after changes means you accept the new terms.
9. Account Termination
You can delete your account at any time. We may also: • Suspend your account if you violate terms • Terminate your account for legal reasons • Reserve the right to discontinue service When account is terminated, your data is deleted according to our privacy policy.
10. Governing Law
These terms are subject to Estonian law and governed by TrairX Technology O.Ü. Disputes are resolved in Estonian courts. However, consumer protection laws in your country may also apply.
